Terms and conditions

The use of Our Website and Our Services means that you accept the following Terms and Conditions and Privacy Policy, which are legally binding.

Please read carefully clause 11 (Health and Safety) of these Terms and Conditions.

Introduction
So Baby is a private limited company registered in England and Wales, number 5432488. Our registered office is So Baby Limited, 114 Northgate Street, Chester, CH1 2HT. We manufacture and deliver baby products which are available for purchase on our Website. These Terms and Conditions are to be entered into between Us and the customer (“You”).

1. So-Baby Guarantee
So-Baby provides top quality baby food. If any unused product fails to please You, please contact us within 24 hours of receipt of your order on 07887 503486. We will refund the value of the unused product, however, we reserve the right to require the return of any unused product for testing. Claims will not be accepted for damages unless reported within 24 hours of receipt of goods.

2. Payment

    2.1 We accept payment via Nochex. Deliveries will only be dispatched when we recieve full payment of goods.

    2.2 Postal order and cheque will only be accepted, if You have placed your order by telephone or by post. When your postal order/cheque is cleared, We will advise You by telephone of the delivery day.

    2.3 If your order includes anything out of stock on the dispatch date, We will contact You by telephone and offer an alternative product which is equivalent to your order. If the alternative is not acceptable to you, We will refund the value of the undelivered product(s). Should We be unable to contact You to advise of a shortage of stock, We will send all items which are available and We will automatically reimburse You for the item which was out of stock.

3. Delivery

    3.1 When selecting your goods on the Website, You will have the option of when you would like delivery of your order. You can choose between a Thursday and a Friday. You will also have the berore noon option between 9.00am to noon (please note that an extra £5 will be included for this option), if this option is not selected, You must be available to accept delivery of your goods all day between 9.00am and 5.30pm (“Standard Delivery”) on the day of delivery.

    3.2 Orders placed before 11am on a Wednesday or Thursday will be dispatched that same day to arrive the following day (Thursday or Friday respectively).  Orders placed between Friday pm and Tuesday pm will be dispatched the first Wednesday after the order to arrive the following day.

    3.3 We work closely with the carrier to ensure orders are delivered on time, however we cannot be held responsible for delays encountered by the carrier (please see clause 4.6 below).

    3.4 You may request delivery to be at any address, however, it is your responsibility to ensure that someone is available at the delivery address at all times during the Standard Delivery period. Someone must be available to sign for the goods on delivery. Delivery of the goods will only be attempted once. You are reminded of the perishable nature of the goods and that should You fail to be present for your delivery, We reserve the right to charge You in full for an amount equal to the cost of the perishable items contained in your order and the cost of delivery.

    3.5 You acknowledge and agree that the goods are perishable in nature and are required to remain frozen, You will place the goods in a freezer on delivery.

    3.6 We reserve the right to restrict deliveries in certain areas, and this includes the right to eliminate certain areas from our delivery schedule altogether.
    Delivery prices quoted are for delivery anywhere in mainland England, Wales & Scotland.  For delivery charges to Channel Islands, Isle of Man Scottish Isles and Northern Ireland, please contact us on 07887 503486.

    3.7 Please note adverse weather conditions or other events outside of Our reasonable control may result in the occasional late or cancelled delivery of your order. We will at all times endeavour to contact You as soon as we are able to, in order to reschedule your delivery time and date. In any event our liability to You will be limited to the price of goods not delivered and the cost of delivery.

4. VAT
Where applicable, VAT will be included in the price of goods. So-Baby VAT registration number is 866 8599 44.

5. Cancellation of Order
You have the right to cancel any order which You have placed with Us, before 9.00am on the day prior to delivery. This can be done by email or phone and will be acknowledged by one of our staff members. We will refund any payment You have made, but We reserve the right to make a charge of 5% to cover the costs incurred by Us handling your payment/credit.

6. Our Liability

    7.1 No liability will be accepted by the Company for any delay in performance of the contract or failure to perform Our obligations with the Customer, if that delay or failure to perform is wholly or partially due,but not limited, to any of the following: Act of God, War, Acts of Terrorism, Fire, Civil Commotion, Restriction by Government or other competent authority, Strike, Riot, Accident, Failure in supplies or to any cause whatsoever beyond our control. In such an event, We reserve the right to cancel or suspend Our Service without incurring any liability to You.

    7.2 In any event, and notwithstanding anything contained in these Terms and Conditions (except in the case of fraud), Our liability in contract, tort (including negligence or breach of statutory duty) or otherwise by reason of or in connection with these Terms and Conditions (except in relation to death or personal injury caused to You by Our negligence) shall be limited to the price paid for the goods and the cost of delivery of those goods. Nothing in these Terms and Conditions will restrict any of your statutory rights.

7. Complaints Procedure
Please email Us at delivery@so-baby.co.uk giving Us as much information as You can about your complaint. We will endeavor to acknowledge your complaint by the next working day and to resolve your complaint within 5 working days.

You may call Us on 07887 503486 at anytime. Outside office hours there is an answer phone service. We will aim to respond to your call within 24 hours (except weekends/public holidays). Alternatively You may email Us at

9. Personal Details
We do not and will not pass on any details about You to any person not directly employed by Us, unless required to do so by the law. The exception is when we take steps to confirm security of a debit/credit card transaction. Delivery information will be disclosed to a delivery or courier service, including contact telephone details.

10. Our Rights

    10.1 We reserve the right to:-

    10.1.1 change, modify, substitute or remove any item, without prior warning, on the Website.

    10.1.2 change Prices, goods and availability of products at anytime.

    10.1.3 refuse service to any customer; and

    10.1.4 amend these terms and conditions without notice.

    10.2 Access to this Website may be suspended temporarily and without notice in the case of system failure, maintenance, new facilities or services or repair or for reasons beyond our control. We shall not be liable for any costs which You may incur.

11. Health and Safety
At So-Baby, it is our main concern that You and your child are happy and healthy. We therefore, ask that you read this section with care. Should any Dry Ice remain in the box on arrival, please ensure that you follow the procedure below:

Handling: Please do not touch any remaining Dry Ice with bare hands, or let it come into contact with bare skin. It will burn. Dry Ice must be kept away from children and animals. Handle with gloves made of a suitable material to protect hands from the extreme cold, (normal woollen gloves will suffice). Dry ice should be disposed of in a normal outside dustbin where it can dissipate into the atmosphere. Due to its increase in volume it must not be disposed of in airtight containers

What is it: Carbon Dioxide (CO²) is more commonly known as Dry Ice. It has a very low temperature which makes it perfect for use as a refrigerant. It has an opaque appearance which changes into a colourless vapor. Dry Ice is neither poisonous nor flammable and is used in many commercial applications including refrigeration for airline catering, home delivery of frozen food and creating fog effects for stage and screen.

13. General

    13.1 These Terms and Conditions constitute to the fullest extent permitted by law the whole of the agreement between You and the Company with regard to the use of the Website and the Service.

    13.2 These terms and conditions are governed by the Laws of England. Under English law, we may not accept orders from anyone who is under 18 years of age.
